2. Definitions
- Client / you: any natural or legal person who enters into an agreement with us or requests a quotation.
- Consumer: a Client who is a natural person and is not acting in the course of a profession or business. Consumers have mandatory rights under Dutch and EU law that these Terms do not affect.
- Business Client: any Client who is not a Consumer, including watch dealers and other traders.
- Timepiece: any watch, movement, component, strap or bracelet delivered to, sourced by, purchased by or sold by us.
- Services: repair, servicing, restoration, water-resistance testing, and related work.
- Trade: our purchase of a Timepiece from you, our sourcing of a Timepiece for you, and our sale of a Timepiece to you.
- Portal: the online customer and dealer account area on our website.
- Agreement: any contract between you and us to which these Terms apply.
3. Scope and applicability
3.1 These Terms apply to every quotation, order, Agreement and delivery relating to our Services and Trade, and to use of the Portal.
3.2 By requesting a Service, sending in a Timepiece, placing an order, entering into a Trade, or creating a Portal account, you accept these Terms. Where we offer a checkbox or similar confirmation at intake or checkout, your acceptance is recorded there; where no such step is available, sending in your Timepiece constitutes acceptance.
3.3 We do not accept the general terms of a Business Client unless we agree to them in writing.
3.4 If any provision of these Terms is void or unenforceable, the remaining provisions stay in force, and the void provision is replaced by a valid one that matches its purpose as closely as possible.
3.5 Nothing in these Terms limits or excludes any right you have as a Consumer under mandatory Dutch or EU law. Where a provision conflicts with such a right, that right prevails.
Part A — Repair and servicing4. Quotations and estimates
4.1 A quotation is based on our assessment of the Timepiece and is non-binding and valid for 10 days from its date, unless stated otherwise.
4.2 An initial online estimate, based on the information and photographs you provide, is free of charge and non-binding.
4.3 For a physical assessment of a Timepiece brought or sent in to us, we charge an assessment and diagnostic fee of €85.00 excluding VAT for inspecting the Timepiece and preparing a quotation. This fee is communicated to you before the inspection takes place.
4.4 If, during the work, we discover that additional work or parts are required, we may proceed without prior approval where the additional cost does not exceed 17.5% of the agreed quotation (excluding VAT). If the required additional work exceeds this amount, we will contact you and request your approval before proceeding.
4.5 If work has already begun and you do not approve the additional parts or work needed to complete it, we stop and carry out no further repair. In that case, the cost of any parts already ordered for your Timepiece remains payable, together with a charge of 40% of the agreed quotation amount (excluding VAT) to cover the work already performed, disassembly, reassembly, and handling of the Timepiece.
5. Formation of the repair Agreement
5.1 An Agreement is formed when you approve our quotation or otherwise instruct us to proceed, and we accept that instruction.
5.2 Estimated turnaround times are communicated after initial assessment. They are indicative only. Unforeseen complications or the need to source parts may extend them. We keep you informed of material delays and give reasonable updates on progress via your preferred channel (email, phone or the Portal).
6. Prices, VAT and payment
6.1 Prices are in Euros (€).
6.2 For Consumers, quoted prices include Dutch VAT (BTW). For Business Clients, prices are exclusive of VAT unless stated otherwise. Shipping and insurance are not included in Service prices.
6.3 All import duties, customs charges and taxes are your responsibility, not ours (see clause 9).
6.4 Invoices set out a breakdown of the work for transparency.
6.5 Full payment is required before a repaired Timepiece is returned or released, unless we agree otherwise in writing. Payment methods accepted will be communicated during the process. Credit card payments are not accepted.
6.6 Until payment is received in full, we retain the Timepiece and any replaced parts, and we may exercise our right of retention (see clause 11).
7. Carrying out the work; parts and subcontracting
7.1 We perform the Services with the care expected of a professional workshop.
7.2 Replaced parts are, where original equipment specifications require it, exchanged for original or equivalent-quality components. Old parts are returned to you only if you request this at intake; otherwise they may be disposed of after collection of the Timepiece.
7.3 We may have all or part of the work carried out by a qualified third party where appropriate. Our warranty and responsibilities under these Terms continue to apply to that work as if we had carried it out ourselves, subject to clause 17.
8. Warranty on Services
8.1 We provide a limited warranty on the work we perform and the movement we service, for the following periods from the date the Timepiece is returned or collected:
| Timepiece | Warranty period |
|---|---|
| Rolex models with a 6-digit reference | 24 months |
| Vintage timepieces | 12 months |
| All other brands and models | 12 months |
8.2 Condition of the warranty. The warranty applies only where the repairs and maintenance we recommend are carried out in accordance with our service standards. Any parts we identify as worn, damaged, or necessary for the correct operation of the Timepiece must be replaced during the service. If you decline a required part, we may cancel the service, as we cannot guarantee the reliability and performance of the Timepiece without it. Charges for a service cancelled after work has begun are set out in clause 4.5.
8.3 The warranty covers only the work we performed and the parts we supplied. It does not cover:
- normal wear and tear, or gradual loss of accuracy within manufacturer tolerances;
- water resistance or any water-related damage. Water resistance testing, if performed, only confirms the condition at the time of testing and does not provide a warranty for future water resistance;
- damage from accidents, misuse, magnetism, or mishandling after return;
- laser work, lapping, polishing, and strap or bracelet repair. These services are performed without warranty;
- work or components not carried out or supplied by us.
8.4 The warranty is void if the Timepiece is opened, serviced or altered by a third party during the warranty period. Before approaching anyone else about an issue with our work, please contact us first so we can help and preserve your warranty.
8.5 Vintage timepieces. Vintage and aged Timepieces may contain brittle, worn or irreplaceable components. We treat them with the greatest care, but we cannot guarantee original waterproofing, original-part availability, or performance equal to a modern watch. This does not limit your statutory rights as a Consumer.
8.6 Water resistance. Water resistance is never guaranteed, under any circumstances. A water-resistance (pressure) test, if performed, only confirms the condition at the moment of testing and does not warrant future water resistance; water damage is excluded under clause 8.3. Timepieces received without original glass or other integral sealing components will not be made water-resistant unless those parts are replaced with suitable originals, at additional cost communicated in advance.
8.7 Consumers: this commercial warranty is in addition to, and does not replace, your statutory rights under Dutch law (including the right to a product/service that conforms to the Agreement). You may always rely on those rights.
9. Shipping, collection and risk (Services)
9.1 If you send your Timepiece to us, you are responsible for secure packaging and for using a reputable carrier with track-and-trace and insurance for the full value of the Timepiece. Guidance is on our packaging page.
9.2 You are responsible for both the outbound and return shipping labels, and for the cost of shipping, unless we agree otherwise.
9.3 We recommend that you document the condition of the Timepiece before shipping.
9.4 Risk during outbound and return transit lies with the carrier and the party who arranges and insures that leg of transport. We are not liable for loss or damage occurring in transit that is outside our control. Where we arrange insured return shipping at your request, the terms of that insurance apply.
9.5 For shipments outside the EU, we declare the full value of the Service on the customs documentation. Any customs charges, duties or import taxes are your responsibility.
9.6 If a Timepiece is lost or damaged by the carrier after completion and during return shipping, the fee for the Service already performed remains payable, save where mandatory law provides otherwise for Consumers.
10. Insurance while in our custody
10.1 While your Timepiece is in our possession under the Agreement, we hold appropriate care over it. You remain responsible for maintaining your own insurance against loss or damage (for example by fire, theft, burglary or other calamity) for its full value, in addition to any cover we hold. This clause does not reduce our liability for damage caused by our own intent or gross negligence (see clause 17).
11. Uncollected Timepieces, storage and right of retention
11.1 We have a right of retention (retentierecht): we may keep a Timepiece until all amounts you owe us in connection with it are paid in full.
11.2 If a Timepiece is ready and you have been notified, please collect or arrange return within three (3) months. After that period we may charge reasonable storage costs, notified in advance.
11.3 If a Timepiece remains uncollected and unpaid for twelve (12) months after we notify you it is ready, and after we have sent you at least one written reminder to a current address or email you provided, we may — to the extent permitted by Dutch law — sell the Timepiece to recover the amounts owed and reasonable costs, and account to you for any surplus. We will always attempt to reach you before taking this step.
Part B — Buy, sell and sourcing12. Selling your watch to us
12.1 When you offer a Timepiece for sale, any price we indicate before physical inspection is provisional. Our final offer is made after we inspect and authenticate the Timepiece.
12.2 A sale is concluded when you accept our written offer. Ownership and risk pass to us on that acceptance and physical handover (or, for remote sales, on our receipt and acceptance of the Timepiece).
12.3 You warrant that you are the lawful owner (or authorised to sell), that the Timepiece is free of any lien, finance, pledge or third-party claim, and that it is not stolen. You agree to provide the identification and ownership evidence described in clause 15.
12.4 We pay the agreed amount by the method and within the timeframe stated in our offer, normally after authentication is complete.
13. Finding / sourcing a watch for you
13.1 On request we search for a specific Timepiece on your behalf. Any indication of availability, price or timing before a Timepiece is secured is an estimate, not a guarantee.
13.2 We tell you the total price (and whether VAT applies under the normal or margin scheme) before you commit. A sourcing Agreement is formed only when you confirm a specific Timepiece and price in writing.
13.3 Where we require a deposit to begin sourcing, its terms (including whether and when it is refundable) are stated at the time.
14. Sale of a watch to you; warranty on sold watches
14.1 We describe each Timepiece we sell as accurately as we can, including its condition and whether it is new, pre-owned or vintage.
14.2 Warranty on watches we sell: 12 months from the date of sale, covering the mechanical functioning of the movement under normal use. It excludes wear parts, straps/bracelets, water resistance (unless expressly stated), and damage from misuse, accident or unauthorised intervention. For Consumers this is in addition to statutory conformity rights.
14.3 VAT / margin scheme. Pre-owned Timepieces may be sold under the EU margin scheme, in which case VAT is not separately shown on the invoice. We tell you which regime applies before purchase.
14.4 Ownership of a Timepiece we sell passes to you only once we have received full payment (retention of title). Risk passes on delivery.
15. Identification, proof of ownership and anti-money-laundering
15.1 Because we deal in high-value goods, we may be required to verify your identity and the provenance of a Timepiece. For Trade transactions we may request valid photo ID, proof of address, and evidence of ownership or purchase.
15.2 We may refuse or unwind a transaction, and where legally required report it, if we have reasonable grounds to suspect a Timepiece is stolen or that a transaction is connected to unlawful activity.
15.3 We handle identification data confidentially and only as described in our Privacy Policy and as required by law.
Part C — General provisions16. Right of withdrawal (Consumers, distance contracts)
16.1 For goods bought at a distance (for example a watch you buy online without seeing us in person), Consumers have a statutory right to withdraw within 14 days of receipt, without giving a reason, by an unambiguous statement to the contact details in clause 1. We will confirm receipt of a withdrawal. On timely withdrawal, you return the Timepiece within 14 days in unused, original condition, and we refund payments received; direct return shipping costs are yours unless we agree otherwise. We may reduce the refund for any diminished value resulting from handling beyond what is necessary to establish the nature and characteristics of the Timepiece.
16.2 Exceptions. The right of withdrawal does not apply to:
- Repair or servicing that you expressly requested and that has been fully performed, once performance has begun with your prior consent and acknowledgement that you thereby lose the right of withdrawal; and
- goods made to your specifications or clearly personalised (for example a bespoke sourcing order or custom work).
16.3 The right of withdrawal does not apply to Business Clients.
17. Liability
17.1 We are liable for direct damage caused by our attributable failure to perform, subject to the limits below.
17.2 Except in the cases in clause 17.4, our total liability per event (or series of connected events) is limited to the greater of (a) the amount you paid us for the Service or Timepiece concerned, and (b) the amount paid out under our applicable insurance for that event.
17.3 We are not liable for indirect or consequential loss, including loss of value, loss of use, loss of profit, or loss of sentimental value.
17.4 Nothing in these Terms excludes or limits our liability where this is not permitted by law, including liability for damage caused by our intent or gross negligence, for death or personal injury, or any other liability that cannot be limited under Dutch mandatory law. For Consumers, statutory rights remain fully intact.
17.5 Any claim must be notified to us in writing within a reasonable time after you discover, or ought reasonably to have discovered, the issue.
18. Force majeure
18.1 We are not obliged to perform if prevented by force majeure, including supplier or third-party failures, unavailability of parts, transport disruption, strikes, fire, government measures, and comparable circumstances beyond our reasonable control. During force majeure our obligations are suspended; if it lasts longer than a reasonable period, either party may terminate the affected Agreement in writing, without liability, save for settlement of work already performed.
19. Images and social media
19.1 We take pride in our work and may photograph and feature Timepieces we service on our website and social media to showcase our craftsmanship. Before publishing, we remove serial and case numbers and other obvious identifying references.
19.2 By sending in a Timepiece you grant us a non-exclusive, royalty-free licence to use, reproduce and display images of the Timepiece for promotional and informational purposes. You retain ownership of the Timepiece; we own the images we create.
19.3 You may object at any time — before or after publication — and we will not publish, or will remove, images of your Timepiece on request within a reasonable period. To opt out in advance, tell us in writing when you send in the Timepiece.
19.4 We will not publish personally identifying content (such as personalised engravings, dedications or images identifying you personally) without your separate consent, and we will not tag you without your agreement.
19.5 We process any personal data involved in accordance with our Privacy Policy and the GDPR, including your rights to object and to withdraw consent.
20. Privacy and data
20.1 We treat your personal details and Timepiece information confidentially and process them in line with our Privacy Policy and applicable data-protection law (GDPR). We do not share your information with third parties except as needed to perform the Agreement (for example a specialist subcontractor or carrier) or as required by law.
21. Online accounts and the Portal
21.1 The Portal lets you view your Timepieces, repair status, quotations, invoices and messages, and submit new requests. You are responsible for keeping your login credentials secure and for activity under your account.
21.2 An account becomes a Dealer Account when a valid KvK number and VAT number are provided. Dealer Accounts are treated as Business Clients under these Terms. We may verify these details and may assign or remove dealer status.
21.3 Information shown in the Portal (such as estimated completion dates and general service status) is provided for convenience and may be updated as work progresses.
22. Complaints and dispute resolution
22.1 If you are not satisfied, please contact us first at Info@watchrepairmaastricht.com. We aim to acknowledge complaints within a reasonable time and to resolve them fairly. If we cannot resolve it together, the dispute may be brought before the competent Dutch court in accordance with clause 23.
23. Governing law and jurisdiction
23.1 These Terms and all Agreements are governed by Dutch law.
23.2 Disputes are submitted to the competent court in the district of Limburg, location Maastricht, without prejudice to any mandatory right of a Consumer to bring proceedings before, or have them heard by, the court designated by law.
24. Amendments
24.1 We may modify or update these Terms. The version in force at the time your Agreement is formed applies to that Agreement. The current version is always available on our website.
By requesting a Service, sending in a Timepiece, entering into a Trade, or creating a Portal account, you confirm that you have read and accept these Terms and Conditions. Thank you for your trust in Watch Repair Maastricht.
